vor über einem Jahr im August 2018 haben wir diese Informationen für euch gesammelt. Diese Informationen sind heute immer noch aktuell.
Auf einige Fragen haben wir auch heute noch keine Antworten. Wir arbeiten weiter daran.

Aktuelle Informationen (November 2019)

Wichtig: Unsere Informationen sind zur Situation in Beirut, Erbil, Amman und Istanbul. Das Verfahren ist überall fast gleich, aber die IOM ist nicht in allen Ländern aktiv.


إجراءات التأشيرات (الفيزا):

Ablauf des Verfahrens:

1. المنظمة الدولية للهجرة ترسل بريد إلكتروني (إيميل) يحتوي معلومات حول الوثائق المطلوبة لأجل طلب الفيزا لجميع من قام بحجز موعد.
قد يكون هناك وقت طويل بين تحديد موعد والاتصال بالمنظمة الدولية للهجرة (حاليا حوالي سنة واحدة في بيروت).
ويقومون لاحقاً بالاتصال للسؤال إذا ما كان الشخص لديه جميع الوثائق.

1. Die IOM verschickt an alle, die schon einen Termin gebucht haben eine E-Mail mit Informationen, welche Unterlagen man für den Visumsantrag braucht.

Zwischen der Terminbuchung und der Kontaktaufnahme durch die IOM kann eine lange Zeit liegen (in Beirut zur Zeit ca. 1 Jahr).
Später ruft sie an und fragt, ob man alle Dokumente hat.


2. عندما يقول الشخص لهم إن لديه جميع الوثائق فمن الممكن أن يحصل على موعد بعد فترة وجيزة. نصيحة: إذا لم تكن لديك جميع الوثائق فمن الأفضل الانتظار أطول قليلا .

2. Wenn man sagt, dass man alle Dokumente fertig vorbereitet hat, kann es sein, dass man sehr kurzfristig einen Termin bekommt.

! Tipp: Wenn man noch nicht alles fertig hat, ist es besser noch ein bisschen länger auf den Termin zu warten.


3. خلال الموعد تتحقق منظمة الهجرة الدولية إذا ما كانت جميع الوثائق لديكم.

في حال نقصان أي شيء يتم تأجيل الموعد، أما في حال وجود جميع الوثائق فيكنكم متابعة الإجراء وهو: جلسة استماع في السفارة أو المنظمة الدولية للهجرة.

3. Beim Termin überprüft die IOM, ob man alle Dokumente hat.

Wenn etwas fehlt, wird man wieder weg geschickt. Nur wenn alle Dokumente vollständig und korrekt sind, kommt man zum nächsten Schritt: Eine Anhörung bei der Botschaft oder der IOM


4. جلسة الاستماع لدى منظمة الهجرة الدولية هي مثل المقابلة الشخصية: وهذه الجلسة قد تطول جداً حيث.

في هذه المقابلة يجب على زوجك أو زوجتك الإفصاح عن كل ما قد يعتبر أسباب حالة إنسانية.

في البلدان التي لا تمتلك فيها المنظمة الدولية للهجرة (FAP) برنامجًا لمساعدة الأسرة ، تجري السفارات هذه المقابلة.

هذه الأسئلة هي لتحديد ما إذا كان لم شمل أسرتك حالة إنسانية„:

أمثلة: هل عائلتكم منفصلة منذ مدة طويلة ؟

وهل من الممكن أن تعيشوا سويةً في بلد آخر؟

هل أحد أفراد العائلة مريض ؟

هل يحتاج إلى رعاية خاصة لا يمكن أن يقدمها له سوى أحد أفراد العائلة ؟ كل هذا يجب إثبات صحته بتقارير طبية.

هل يعاني الأطفال من مشاكل نفسية بسبب تفرق العائلة؟

هناك عدة علامات تدل على أن الأطفال يعانون من ضغط نفسي

هذه الأسباب مهمة , تدل على أن الطفل في خطر .

هل أفراد عائلتكم بخطر؟

هل لديهم مشاكل مع المؤسسات الحكومية؟ هل يتم تهديدهم من قبل احد الجيران؟ هل يعيشون في مناطق نزاعات مسلحة؟

غير ذلك تقوم المنظمة الدولية للهجرة بالتحقق إذا ما كنتم عائلة قبل خروج الشخص الذي في ألمانيا من سوريا.

نصيحة: احضروا معكم صور قديمة معاً أو صور حفل الزفاف.

مهم: الموظفين سيكتبون كل ما سوف تقولونه ولكن هذه المعلومات تقدم فقط للسفارة الألمانية والمؤسسات الألمانية ولن يتم إرسالها لأي مؤسسة سورية أو لبنانية, عراقية , أردنية ….الخ

نصيحة: اكتبوا مسبقا كل ما سيقوله أفراد عائلتكم بالألمانية وقدموه كطلب رسمي في المقابلة حيث سيكون هذا الطلب مهم جداً في حال تم رفض طلب الفيزا و أردتم الطعن في هذا القرار.

4. Die Anhörung ist eine Art Interview:

Das kann ein sehr langes Gespräch sein. In diesem Gespräch müssen eure Ehemänner oder Ehefrauen alles erzählen, was Gründe für einen „Humanitären Fall“ sein können.
In Ländern in denen die IOM kein „Family Assistance Programme (FAP)“ hat, führen die Botschaften dieses Interview durch.

Mit diesen Fragen soll festgestellt werden, ob es bei eurer Familienzusammenführung um einen „humanitären Fall“ geht:

Ist eure Familie schon sehr lange getrennt?
Gibt es die Möglichkeit in einem anderen Land zusammen zu leben?
Ist jemand in der Familie sehr krank? Braucht die kranke Person Pflege, die nur ein Familienmitglied geben kann? Das müsst ihr mit einem ärztlichen Attest beweisen.
Leiden die Kinder unter der Familientrennung und haben psychische Probleme?
Es gibt viele Zeichen für seelische Probleme von Kindern – sprecht darüber! Das sind wichtige Argumente dafür, dass das „Kindeswohl“ in Gefahr ist.
Sind eure Familienmitglieder in Gefahr? Gibt es Probleme mit syrischen Behörden? Gibt es Drohungen von Nachbarn? Leben sie in einem Gebiet, in dem Kämpfe sind?

Außerdem überprüft die IOM, ob ihr schon eine Familie wart, bevor die Person, die jetzt in Deutschland ist, geflohen ist.

! Tipp: Am besten bringt ihr Hochzeitsfotos oder Familienfotos mit.

! Wichtig: Die Mitarbeiterinnen und Mitarbeiter schreiben alles auf, was ihr sagt.

Die Informationen gehen nur zur Botschaft und zu deutschen Behörden – nicht zu syrischen Behörden oder den Behörden in Jordanien, dem Irak oder der Türkei.

! Tipp: Wir empfehlen, alles was eure Ehefrauen / Ehemänner erzählen werden, auch vorher auf zu schreiben (auf Deutsch) und einen schriftlichen Antrag mit zu bringen. Der Antrag kommt dann zu der Akte des Visumsantrags. Wenn eure Familie kein Visum bekommt und ihr klagen wollt, ist das ein wichtiges Dokument.


5. تقوم السفارة بفحص الأوراق.

ثم تقوم بإرسالها إلى دائرة الأجانب المسؤولة عن الشخص الموجود ( فرد العائلة ) في المانيا.

5. Die Botschaft überprüft eure Dokumente.

Dann leitet sie den Antrag weiter an die zuständige Ausländerbehörde, das ist die Ausländerbehörde am Wohnort der Person, die schon in Deutschland ist.


6. مكتب الأجانب في مقاطعتكم سيكتب تعليقه ويشرح مدى حسن إندماج الشخص في ألمانيا، المعايير للاندماج الجيد هي إثباتات بمعرفة اللغة الألمانية (شهادات الامتحانات)، إثباتات أن الشخص قام بعمل طوعي، إذا كان لديه شقة سكنية، إذا ما كان يقوم بعمل تدريب مهني أو يدرس بالجامعة.

الاندماج الجيد يحسن من فرص الموافقة على طلب لم الشمل. إذا تم اختيار.

بالإضافة إلى ذلك يفحص مكتب الأجانب التقارير الطبية و الإثباتات عندما يكون الشخص في ألمانيا مريض أو لديه إعاقة.

نصيحة: إذا كانت لديكم وثائق تثبت إندماجكم الجيد فمن الأفضل تقديمها مع بقية الوثائق في المقابلة بالسفارة، وعندما تحصلون على وثائق جديدة أو تقارير طبية جديدة أرسلوها إلى مكتب الأجانب (الآوسلندربيهوردة) مع رقم طلب الفيزا الخاص يأفراد عائلتكم واسمك وأسماء أفراد عائلتكم.

إذا استغرقت معالجة طلب التأشيرة وقتًا طويلاً ، فعادة ما يعود الأمر إلى مكتب الهجرة المسؤول:

بعض مكاتب الأجانب ترسل لكم بريداً وتطلب إثباتات وبعضهم يعتمد على ما لديهم في ملفاتكم من إثباتات.

6. Die Ausländerbehörde schreibt eine Stellungnahme:

Sie schreibt wie gut die Person, die schon in Deutschland ist, integriert ist. Kriterien dafür sind: Deutschkenntnisse (Prüfungen), Nachweise über ehrenamtliches Engagement, eine Wohnung, Arbeit / Ausbildung / Studium.
Für gute Integration gibt es Pluspunkte für den Visumsantrag, falls eine Auswahl getroffen wird.
Außerdem überprüft die Ausländerbehörde, die Atteste oder Nachweise, wenn ein Familienmitglied in Deutschland krank oder behindert ist.

! Tipp: Wenn ihr Dokumente habt, die eure gute Integration beweisen, gebt sie am Besten schon zum Visumsantrag mit ab.
Wenn ihr später noch neue Dokumente bekommt, schickt sie an die Ausländerbehörde und schreibt die Nummer des Visumsantrags, euren Namen und den Namen eurer Familienmitglieder dazu. Genauso macht ihr das mit aktuellen Attesten.

Wenn die Bearbeitung des Visumsantrags sehr lange dauert liegt es meistens an der zuständigen Ausländerbehörde:

Manche Ausländerbehörden schreiben einen Brief, und fragen nach Nachweisen – andere entscheiden nach dem, was sie in den Akten haben. Das ist an jedem Ort bzw . in jedem Bundesland anders.


7. في النهاية يقرر المكتب الاتحادي الإداري:

يقول القانون: يجب على المكتب الفيدرالي للإدارة اختيار الحالات الإنسانيةالأكثر إلحاحًا لجميع طلبات التأشيرة لكل 1000 شخص شهريًا. يجب أن يحصل هؤلاء الأشخاص على تأشيرة من السفارة.

ولكن بسبب فترات الانتظار الطويلة والإجراءات المعقدة ، يصل أقل من 1000 طلب تأشيرة شهريًا إلى المكتب الفيدرالي للإدارة. ثم لا يجعل أي خيار ، هذه الحالة أكثر إلحاحًا. ثم يتفق مع جميع التطبيقات.

7. Am Ende entscheidet das Bundesverwaltungsamt:

Das Gesetz sagt: Das Bundesverwaltungsamt soll unter allen Visumsanträgen 1000 Menschen pro Monat die dringendsten „Humanitären Fälle“ auswählen. Diese Menschen sollen dann ein Visum von der Botschaft bekommen.
Aber wegen der langen Wartezeiten und dem komplizierten Verfahren kommen weniger als 1000 Visaanträge monatlich beim Bundesverwaltungsamt an. Dann trifft es keine Auswahl, welcher Fall dringender ist. Dann stimmt es allen Anträgen zu.
Trotzdem waren das seit August 2019 nur noch ca 800 Visaanträge pro Monat.


في أي حالة يتم رفض الطلب؟

Wann bekommt man eine Ablehnung?

Bisher stimmt das Bundesverwaltungsamt allen Anträgen zu, die es von den Ausländerbehörden weitergeleitet bekommt.

Aber es kann sein, dass der Visumsantrag von der Botschaft oder der Ausländerbehörde abgelehnt wird.
Die häufigsten Begründungen für eine Ablehnung sind:
• Man hat nach der Flucht aus dem Herkunftsland geheiratet.
• Die Botschaft akzeptiert die Heirats- oder Familienstandsdokumente nicht.
• Die Behörden behaupten, dass man in einem anderen Land zusammen leben kann.


متى يستطيع الشخص الطعن؟

لم نسمع عن أي رفض على أساس عدم وجود حالة إنسانية„. أو من الرفض ، حيث كان السبب هو أن الحصة ممتلئة.

بعض سلطات الهجرة ترفض الطلبات بسبب عدم وجود منزل ، أو أن سبل العيش غير مضمونة أو أن واحدة غير مدمجة بما فيه الكفاية. لهذه الأسباب ، قد لا يرفض مكتب الهجرة لم شمل الأسرة للاجئين المحميين.

Wann kann man klagen?

Manche Ausländerbehörden lehnen Anträge ab, weil es noch keine Wohnung gibt oder der Lebensunterhalt nicht gesichert ist oder man nicht genug integriert ist. Aus diesen Gründen darf die Ausländerbehörde den Familiennachzug zu subsidiär geschützten Flüchtlingen nicht ablehnen.
Eine Remonstration (= Widerspruch bei der Botschaft) oder eine Klage hat in diesen Fällen gute Chancen.
In den meisten anderen Fällen kommt es auf den Einzelfall an.

Wir informieren uns zur Zeit noch genauer über die Frage „Welche Chancen haben Klagen bei Gericht“. Diese Informationen werden wir dann auch in einem Infoblatt veröffentlichen.


متى وكيف يستطيع الشخص السؤال أين يوجد طلبه؟

Wann und wie kann man fragen, bei welcher Behörde der Antrag gerade ist?

Man kann per E-Mail bei der Botschaft nachfragen. Dann weiß man wenigstens, bei welcher Behörde der Antrag gerade liegt.
Aber wir glauben nicht, dass der Antrag dadurch schneller bearbeitet wird.

Over a year ago in August 2018 we collected this information for you. This information is still up to date today.
We still have no answers to some questions today. We continue to work on it.
Current information (November 2019)
Important: Our information is about the situation in Beirut, Erbil, Amman and Istanbul. The procedure is almost the same everywhere, but the IOM is not active in all countries.

Procedure:

1. The IOM sends an e-mail to everyone who has already booked an appointment with information on which documents are required for the visa application.

There can be a long time between booking the appointment and contacting the IOM (currently about 1 year in Beirut).
She later calls and asks if you have all the documents.

2. If you says that you have prepared all the documents, you may get an appointment at very short notice.

! Tip: If you don’t have everything ready, it’s better to wait a little longer for the appointment.

3. At the appointment, the IOM checks whether you have all the documents.

If something is missing, you will be sent away again. Only when all documents are complete and correct can you proceed to the next step: a hearing at the embassy or the IOM

4. The hearing is a kind of interview:

it can be a very long conversation. In this conversation, your husbands or wives must tell everything that could be reasons for a „humanitarian case“.
In countries where the IOM does not have a Family Assistance Program (FAP), the embassies conduct this interview.

These questions are intended to determine whether your family reunification is a “humanitarian case”:

Has your family been separated for a long time?

Is it possible to live together in another country?

Is someone in the family very sick? Does the sick person need care that only a family member can give? You have to prove that with a medical certificate.

Do the children suffer from family separation and have psychological problems?
There are many signs of children’s mental problems – talk about them! These are important arguments that the „child’s well-being“ is in danger.

Are your family members in danger? Are there any problems with the Syrian authorities? Are there any threats from neighbors? Do you live in an area where there are fights?

The IOM also checks whether you have been a family before the person who is now in Germany has fled.
! Tip: It is best to bring wedding photos or family photos with you.

! Important: The employees write down everything you say.

The information only goes to the embassy and German authorities – not to the Syrian authorities or the authorities in Jordan, Iraq or Turkey.

! Tip: We recommend that you write down everything your wives / husbands will tell in advance (in German) and bring a written application with you. The application then comes to the file of the visa application. If your family doesn’t get a visa and you want to sue, that’s an important document.

5. The embassy checks your documents.

Then the embassy forwards the application to the responsible immigration office, which is the immigration office at the place of residence of the person who is already in Germany.

6. The immigration office writes a statement

on how well the person who is already in Germany is integrated. Criteria for this: Knowledge of German (exams), evidence of voluntary work, an apartment, work / training / studies.
For good integration, there are plus points for the visa application if a selection is made.
The immigration office also checks the certificates or evidence if a family member is ill or disabled in Germany.

! Tip: If you have documents that prove your good integration, it’s best to hand them in with your visa application.
If you get new documents later, send them to the immigration office and write the number of the visa application, your name and the name of your family members. You do the same with current certificates.
If it takes a long time to process the visa application, it is usually up to the responsible immigration office:
Some immigration authorities write a letter and ask for evidence – others decide what they have on file. That is in every place or. different in each state.

7. In the end, the Federal Administrative Office decides:

The law says: The Federal Office of Administration should select the most urgent „humanitarian cases“ from 1,000 visa applications per month. These people should then get a visa from the embassy.

But because of the long waiting times and the complicated procedure, fewer than 1000 visa applications arrive at the Federal Office of Administration every month. Then there is no selection made, which case is more urgent. Then it approves all requests.
Nevertheless, since August 2019, there were only about 800 visa applications per month.

When do you get a rejection?

So far, the Federal Office of Administration has approved all applications that it received from the immigration authorities.

But it may be that the visa application is rejected by the embassy or the immigration office.
The most common reasons for a rejection are:
• You got married after fleeing your country of origin.
• The embassy does not accept marriage or marital status documents.
• The authorities claim that you can live together in another country.

When can you take legal action?

Some immigration authorities reject applications because there is still no apartment or the livelihood is not secured or one is not sufficiently integrated. For these reasons, the immigration office may not reject family reunification with refugees protected under subsidiary law.
A remonstration (= objection to the embassy) or a lawsuit has good chances in these cases.
In most other cases, it depends on the individual case.

We are currently getting more information about the question „What are the chances of lawsuits in court“. We will then publish this information in an information sheet.

When and how can you ask which authority is the application?

You can ask the embassy by email. Then at least you know which authority the
application is currently at.
But we don’t think it will process the application faster.


Finally, something about us:

We, the initiative ‚Family life for everyone!‘ are against this law. Because it means arbitrary authority and for many families it means: wait, wait, wait …

    Meine Name ist Hussain aus Syrien und seit 4 Jahren wohne ich mit meiner Familie in Berlin.

    Ich bin verheiratet und ich habe 1 Kind und das kind ich habe noch nicht gesehen,weil der zeit wenn ich Flüchte nach Deutschland mein Frau war Schwanger.
    Ich komme aus Pakistan und Seit 4 jahre
    Ich bin in deutschland und am 18.06.2020 ich habe Subsidiäre Schutz von Stuttgart Verwaltungsgericht bekommen.
    Gerade ich bin in Ausbildung als Altenpfleger und ich bin in 3 Lehrjahr
    ich habe ein Frage wegen Familienachzug darf ich meine Familie nach Deutschland umziehen

    mein Name ist M. ### (Zum Schutz der Privatsphäre von der Redaktion anonimisiert). Ich bin am 11. November 2022 als afghanische Ortskraft nach Deutschland gekommen. Ich wohne jetzt in einer Wohngemeinschaft in Stuttgart.

    Aber meine Familie ist immer noch in Afghanistan. Mein Vater hat für die afghanische Regierung gearbeitet und ist daher seit der Machtübernahme der Taliban in großer Gefahr.       Diese Nachricht macht mich sehr traurig. Denn wir können Ihnen leider nicht helfen. Wir sind nur eine kleine NGO und haben keinen Einfluss auf das Handeln der GIZ, des auswärtigen Amts oder der Bundesregierung.
      Die Informationen die die GIZ Ihrem Vater geschickt hat helfen Ihnen und vielen anderen verfolgten Menschen in Afghanistan leider auch nicht. Denn Ihr Vater, Ihre Mutter, Ihre Schwestern und Brüder sind nach den deutschen Gesetzen keine engen Familienangehörigen. Für sie ist eine Familienzusammenführung nicht möglich. Familienzusammenführung ist nach den deutschen Gesetzen in der Regel nur für eine Ehefrau, oder einen Ehemann und die eigenen Kinder unter 18 möglich.
      Wir denken das ist grausam und unmenschlich und hoffen, dass diese Gesetze irgendwann geändert werden.

      Wir hoffen sehr, dass Ihre Familie eine andere Lösung finden wird!

    My wife and my son (13years old) are Ukrainian citizens. They have temporary protection in Germany because of the war. They have been living in Cologne for 18 without me . I am Turkish citizen ( also have permanent residency in Ukraine)and now living in Istanbul for 18 months without my family.
    I am registered for family Reunification and waiting ( 5months)for appointment from German Embassy in Istanbul. But still no date has been given. I asked to Embassy hundred times which documents i have to prepare. They answered “ everything written on website“ but situation is not common. I don’t have A1 level German language certificate. Muss i have to This certificate since i have a son Germany?
    Other question my wife didn’t write migration office about me in 90 days?

    I wonder if the embassy will reject me?
